Application for Medicaid was submitted this week. She should qualify, will be less than $2,000 in assets (less than 2800 income).


Time is running out since Medicaid appears to take so long.


She is physically and mentally disabled with dementia. Can they toss her out on street ?


No one has signed for financial responsibility.


We are in Reno, Nevada. Any attorney reference would be appreciated.

I think they can try and evict her if she cannot pay, however I don't think they can just kick her out on the street, they have to discharge her to a safe place. Talk to the ALF and ask them what alternatives she has.

Do they ACCEPT Medicaid?
If they do they are likely to wait, as it is assured income for them, likely for the life of your mom.
They cannot do an unsafe discharge, so if family won't collect her there is little they can do but begin eviction proceedings which will take time.

Do "good faith reporting" to the admins of the facility and show them the paperwork, and assure them.

What state is she is? NC has a program called Special Assistance that only pays for assisted living facilities, which includes Memory Care units. The income and asset requirements are similar to Medicaid, but it’s a state run program. I’d check to see if her state has something similar.

So, she doesn't have a PoA or legal guardian?

In most states' the Medicaid program pays for LTC only. You should discuss your Mom's situation with a Medicaid Planner for NV.

Consider contacting a social worker for the county her facility is in to discuss having a judge order a guardian for her. When this happens then the guardian make sure she gets the basics of care.

The Medicaid app takes 3 months to process.

Are you communicating with the facility?

Do they even take medicaid?

You can not force the facility to keep her if they don't accept medicaid, so talk with them and find out what the next step is because they will get her out if they need to and then you are reacting to a crisis instead of planning the next step. No need to make a hard situation even harder, imo.

How long will an ER keep a person?

A friend of mine who is a retired nurse said that they routinely sent patients home in a taxi if they didn’t have family to pick them up.

If a person has no home, what is generally done?

I know in cases where someone is dying they usually are able to find a facility for them. What if they aren’t dying?
